Fees for services already performed, committed third-party expenses, and other lawfully earned charges are generally nonrefundable unless otherwise required by law or expressly agreed in writing.

  • Unsafe, threatening, hostile, illegal, unsanitary, or materially disruptive conditions exist at the service location.

  • Documents are materially incomplete, contain apparent irregularities, or cannot be processed or executed lawfully.

The Company and its representatives may immediately leave a service location when conditions become unsafe, threatening, or materially disruptive.

When services are refused, suspended, or terminated for reasons attributable to the Client, a required participant, or the service location, applicable cancellation fees, earned service charges, and authorized expenses may remain payable in accordance with the Company's cancellation policies and applicable service agreement.

  • Inaccurate information, false statements, omissions, misrepresentations, or unauthorized actions by Clients, signers, participants, or other third parties.

  • Delays, cancellations, or interruptions caused by traffic, severe weather, emergencies, facility restrictions, security procedures, government actions, or other events beyond the Company's reasonable control.

  • Decisions, requirements, processing times, or actions of independent laboratories, government agencies, shipping carriers, financial institutions, and other third-party service providers, except to the extent liability arises from the Company's own conduct.

  • Business interruptions, lost profits, lost opportunities, or indirect, incidental, special, or consequential damages, to the extent such damages may lawfully be excluded.

The Company does not guarantee that a document, application, specimen, test result, or other service deliverable will be accepted, approved, or processed by a third party unless an express written guarantee is provided.

To the fullest extent permitted by applicable law, the Company's aggregate contractual liability arising from a particular service shall not exceed the amount actually paid to the Company for the specific service giving rise to the claim.

This limitation does not apply to liability that cannot lawfully be limited or excluded, including liability arising from fraud, willful misconduct, or other conduct for which applicable law prohibits such limitations.

Nothing in these Terms waives or restricts any statutory rights, professional obligations, or legal remedies that cannot lawfully be waived or restricted.

You are not required to indemnify the Company for claims or damages resulting from the Company's own negligence, willful misconduct, fraud, or violations of applicable law.

Any obligation to defend the Company against a third-party claim shall be subject to applicable law, reasonable notice of the claim, and the Client's opportunity to participate in the defense.

Nothing in this provision requires indemnification where such an obligation is prohibited by applicable law.

My Indiana Notary, LLC respects the privacy and confidentiality of personal, financial, medical, employment-related, genetic, and other sensitive information obtained or encountered in connection with its services.

The Company takes reasonable administrative, technical, and physical measures to safeguard nonpublic personal information against unauthorized access, disclosure, alteration, or misuse, consistent with applicable law and the nature of the services provided.

Such information will be handled in accordance with applicable legal requirements, authorized service procedures, and the Company's Privacy Policy.

Because mobile services may be performed in private residences, hospitals, senior living communities, correctional facilities, workplaces, public locations, or other environments outside the Company's control, the Company cannot guarantee complete privacy or confidentiality within those environments.

Additional information regarding the collection, use, disclosure, protection, and retention of personal information is provided in the Company's separate Privacy Policy, which should be reviewed in conjunction with these Terms.

Nothing in these Terms authorizes the collection, use, or disclosure of information in violation of applicable law or eliminates any separate consent or authorization required for a particular service.

For notarial services, the commissioned notary must independently determine whether the signer satisfies applicable legal requirements. Statements or assurances from family members, caregivers, attorneys, or facility personnel do not replace the notary's independent assessment.

The Company may decline or discontinue services when facility restrictions, participant circumstances, or applicable legal requirements prevent proper completion.

The Company does not guarantee a particular genetic relationship finding, laboratory result, processing time, or acceptance of results by a court, government agency, or other third party.

DNA and genetic information will be handled in accordance with applicable law, authorized testing procedures, required consents, and the Company's Privacy Policy.

Clients and their legal representatives remain responsible for determining document requirements, legal deadlines, filing obligations, execution instructions, and the legal sufficiency of documents.

The Company will disclose material third-party involvement when relevant to the requested service and will coordinate authorized services in accordance with applicable agreements and legal requirements.

The Company does not control the independent decisions, processing times, or service availability of third-party organizations.

However, the use of a third-party provider does not eliminate the Company's responsibility for its own acts, omissions, contractual obligations, or duties imposed by applicable law.

Clients may be required to complete additional forms, provide information, or accept separate provider-specific terms when necessary for the selected service.

🖥️ 22. Electronic Records, Signatures, and Service Documentation

The Company may use electronic quotations, service agreements, questionnaires, invoices, payment authorizations, scheduling confirmations, disclosures, and other business records in connection with its services.

Where permitted by applicable law, electronic signatures and affirmative electronic acceptance may have the same legal effect as handwritten signatures.

Clients are responsible for reviewing electronic documents before acceptance and ensuring that the information they provide is accurate and complete.

The Company may maintain electronic records documenting quotations, agreement acceptance, service authorization, communications, payments, and other legitimate business activities, subject to applicable law and its Privacy Policy.

Electronic acceptance of a Company service agreement does not replace any personal appearance, handwritten signature, notarization, specimen consent, or other procedure separately required by law.

Where applicable, the Company may retain documentation identifying the Terms of Service in effect when an agreement was accepted.

Records will be retained and handled in accordance with applicable legal requirements and established Company procedures.
